New York Times and three papers sue Brave over AI answers and ad blocking

The New York Times, the New York Daily News, the Chicago Tribune and the Orlando Sentinel filed two federal suits against Brave Software on November 2, 2026 in the Southern District of New York. They say Brave copies their articles into a search index it sells to AI companies and serves paywalled text through its AI answers. One count, unjust enrichment, targets Brave’s practice of blocking publishers’ ads and selling its own.
Our take
Watch the ad blocking count more than the copyright ones, since the papers say it does not depend on any copying. If it holds, swapping a site’s ads for your own becomes a legal risk, not just a business model. Brands that buy Brave ads or lean on AI search answers should keep an eye on this case and avoid long commitments until it moves.
